Sazerac sells two similar-looking products: Fireball Cinnamon Whisky, a distilled spirit, and Fireball Cinnamon, a malt beverage sold in the small bottles often stocked near convenience-store checkouts. The malt version contains no distilled whisky — it is a blend of malt beverage, wine and flavoring — but its packaging closely mirrors the whisky product’s.
The front label reads “malt beverage with natural whisky & other flavors,” which plaintiffs say is engineered to suggest the drink contains whisky when it only contains whisky flavoring.
What the Court Did
A federal judge in California denied Sazerac’s motion to dismiss, finding that features of the malt beverage’s packaging “could affirmatively mislead consumers.” Surviving a motion to dismiss is not a win on the merits, but it means the deception claim was plausible enough to move forward — the opposite of the outcome in some other food-label cases that get tossed early.
So unlike several look-alike-label suits, this one advanced.
