Why There Is No Meaningful Average

Published averages for this kind of claim are close to useless, because they are pulled upward by a small number of very large outcomes and downward by a long tail of minor ones. Two claimants with the same diagnosis routinely settle for very different amounts.

What is actually predictable is the structure. Settlement programmes assign claims to tiers using defined criteria, and understanding which tier your circumstances point to is far more informative than any headline figure.

⚠️

Treat any specific payout figure with suspicion

No one can tell you what your claim is worth before the records are reviewed and, in consolidated litigation, before a settlement matrix exists at all. A confident per-person number offered early is a marketing claim, not a valuation.

What Actually Drives Value

The following factors do most of the work. They are listed roughly in order of impact, and each is established with documents rather than assertion.

Which claim tier you file under

Settlements typically offer a modest flat payment requiring no proof, and a substantially higher documented-loss tier capped at a stated maximum. The gap between them is large, and documentation is the only thing that bridges it.

Documented out-of-pocket loss

Fraudulent charges not reimbursed, costs of freezes and monitoring, and fees incurred resolving identity theft. Receipts and statements are what qualify these.

Time spent, at a stated rate

Most settlements compensate time resolving breach-related problems at a fixed hourly rate up to a capped number of hours, on a sworn statement rather than proof.

Sensitivity of the exposed data

Settlements involving Social Security numbers, medical records or financial credentials are generally funded more richly than those involving contact details alone.

What Is Deducted Before You Are Paid

Claim rates in consumer breach settlements are typically low. That means per-person payments often exceed the initial estimate for those who actually file, and are zero for the large majority who never submit a claim before the deadline.

The gross tier figure is never the net figure. Asking for an itemised estimate of fees, costs and expected lien exposure before agreeing to a settlement is normal and reasonable.

Timing and What Happens Next

Standing and certification are frequently litigated and appealed before any settlement, so these cases commonly run two to four years, with administration adding further months.

This sits within our wider coverage of Data Breach Lawsuits, which sets out the shared background these cases have in common.

Data Breach Settlement Amounts: What Class Members Receive: Frequently Asked Questions

Answers to the most common questions about this case and your legal options.

How much is my claim worth?

Nobody can answer that responsibly without reviewing your records, and in consolidated litigation often not until a settlement matrix exists. What can be assessed early is which tier your circumstances point toward and what evidence would move you up one.

Why do published averages vary so much?

Because they mix categories that should not be mixed: different injuries, different jurisdictions, trial verdicts alongside negotiated settlements, and gross figures alongside net ones. A single large verdict can move a reported average dramatically.

Will I receive the tier amount I am quoted?

No. Attorney fees, case costs, common benefit assessments in consolidated litigation, and medical or insurer liens are deducted first. The net figure is commonly well below the gross tier value, and lien resolution can take months.

Does settling faster mean receiving less?

Often, though not always. Early offers are usually made before treatment is complete or before the litigation has established what claims are worth, which is why experienced counsel generally waits for medical stability or for a matrix to exist.

Is a settlement taxable?

Compensation for physical injury or physical sickness is generally excluded from federal income tax. Interest, punitive damages and purely emotional distress amounts are generally taxable, and previously deducted medical expenses may be recaptured. Allocation within the settlement affects the result.
