Limitation is jurisdictional rather than procedural. Once the period expires a court will normally dismiss regardless of how strong the evidence is, and defendants raise it as an early defence precisely because it avoids the merits entirely.

When the Clock Starts

The critical clock runs from when the loss appeared on your statement or when you learned of the unauthorised transfer, not from any later dispute.

This is the fact most worth establishing early, because it is frequently more contested than whether the period has run. Fixing it to a document rather than to recollection is what makes the answer defensible.

Reporting speed caps your liability

Reporting within two business days of learning of the loss generally caps your exposure at a low fixed amount. Waiting longer raises that cap substantially, and waiting beyond 60 days from the statement can mean bearing the full loss.

The provider has its own investigation deadlines

Once you report, the provider must investigate within set periods, commonly ten business days with an extension available if provisional credit is issued. Missing those is itself a violation you can rely on.

Court claims run on longer state periods

A lawsuit over the provider handling of the dispute follows state consumer protection or contract periods, which are years rather than days.

The lawsuit itself must be filed with the court, or the required administrative claim submitted where one is a prerequisite. Contacting a lawyer does not stop the clock, and representation arranged close to a deadline may not leave enough time to prepare.
