Where to Get the Right Form

Almost every United States court publishes its own approved forms free on its website, and small claims and family divisions usually have fill-in-the-blank versions designed for people without lawyers. These are the correct starting point, not a generic template.

Using a form from the wrong jurisdiction is a common reason filings are rejected. Formatting, caption structure, required cover sheets and filing fees all vary by court, and clerks cannot accept a document that does not comply.

Court self-help centres are free

Many courthouses run self-help centres that assist with selecting and completing the right forms at no charge. They cannot give legal advice, but they can confirm you are using the correct document and have completed it properly.

A caption naming the court, the parties and the case number. A statement of jurisdiction explaining why this court can hear the matter. Numbered factual allegations setting out what happened, in plain chronological order.

Then the causes of action, each identifying a legal claim and connecting it to the facts, followed by a prayer for relief stating exactly what you want the court to order, and a signature block. A demand for jury trial is included where you want one and are entitled to it.

Facts, not argument

Complaints state facts and legal claims, not persuasion. Long narratives of how unfairly you were treated add length without strengthening the pleading, and can introduce admissions. Keep allegations short, numbered and factual.

After Filing

Filing is only the first step. The defendant must be formally served under your state rules, and improper service is one of the most common reasons cases stall or are dismissed.

Deadlines then run automatically. The defendant has a set period to respond, and if they do, you may face motions requiring a timely reply. Calendar every date from the moment you file.
