The Injuries
Transvaginal mesh (also called pelvic or surgical mesh) was implanted to treat pelvic organ prolapse and stress urinary incontinence, common conditions after childbirth or with age. Thousands of women who received Ethicon — a Johnson & Johnson company — mesh products alleged the devices caused severe, lasting harm: the mesh could erode through vaginal tissue, contract and cause chronic pelvic pain, painful intercourse, recurring infections and incontinence, often requiring multiple corrective surgeries that could not fully remove the mesh. This is distinct from hernia mesh, which is used in a different part of the body.
Plaintiffs alleged the makers failed to adequately warn patients and surgeons of these risks.
The Verdicts and Settlements
The transvaginal-mesh litigation became one of the largest mass torts in US history, with tens of thousands of cases against several manufacturers; Ethicon eventually resolved large numbers of individual injury claims. Trials that did go forward produced striking verdicts against J&J/Ethicon, including awards of tens of millions of dollars to individual women (for example verdicts around $57 million and $80 million, the latter with substantial punitive damages). Separately, J&J and Ethicon agreed to a roughly $117 million settlement with the attorneys general of 41 states and the District of Columbia over deceptive marketing of the devices, and a California court ordered a large judgment on similar marketing claims.
