Limitation is jurisdictional rather than procedural. Once the period expires a court will normally dismiss regardless of how strong the evidence is, and defendants raise it as an early defence precisely because it avoids the merits entirely.

When the Clock Starts

For a surviving child the clock is commonly paused during minority. For a wrongful death claim it generally runs from the date of death without that pause.

This is the fact most worth establishing early, because it is frequently more contested than whether the period has run. Fixing it to a document rather than to recollection is what makes the answer defensible.

Tolling for minors is the key rule

Many states suspend the limitation period while the injured person is a minor. This means claims about NICU care years ago may still be timely, but the rule and its limits vary considerably by state.

Wrongful death does not get the same protection

Where an infant died, the claim generally runs from the date of death on the ordinary period. Those deadlines are frequently much closer than parents expect.

A statute of repose can still apply

Some states impose an outer limit that runs regardless of minority tolling, which can cut off even a tolled claim.

What happens if I miss the deadline?
