Lemon law: repurchase less a use offset

The remedy is generally repurchase or replacement, reduced by a statutory offset for the mileage driven before the defect appeared. The formula is set by statute, so the outcome is largely calculable in advance.

Class actions: repair, warranty extension or partial reimbursement

Model-wide economic loss settlements typically provide free repair, an extended warranty, or reimbursement of repairs already paid for. Cash components are usually modest.

Diminished value

Where a defect is publicly known, resale value falls even after repair. Some settlements address this and many do not, which is a common source of dissatisfaction with class outcomes.

Injury claims are valued separately and are far larger

A crash caused by a defect is a product liability claim valued on medical costs, lost earnings and permanent harm. It is generally excluded from consumer class settlements and survives them.

What Is Deducted Before You Are Paid

Lemon law and warranty statutes commonly shift attorney fees to the manufacturer, so the consumer recovery is not reduced by legal fees in the way a contingency injury claim is.

The gross tier figure is never the net figure. Asking for an itemised estimate of fees, costs and expected lien exposure before agreeing to a settlement is normal and reasonable.
