What if my vehicle is out of warranty?

Claims may still be available where the defect was present at manufacture, where the manufacturer extended coverage for that component, or through a class action covering the model. Some states also recognise claims for defects concealed during the warranty period.

Can I join a class action and still sue individually?

Not for the same claim unless you opt out. Class members are bound by the settlement for the claims it covers. Personal injury claims are generally excluded from consumer class settlements and survive separately.

What can a lemon law claim recover?

Typically repurchase of the vehicle or replacement, less a deduction for use. Many statutes also provide incidental costs such as towing and rental, and attorney fees, which is what makes these claims economically viable to bring.
