The Total-Loss Underpayment Claims

The largest cluster of GEICO cases concerns total-loss claims — when a car is declared a total loss and the insurer pays its value. Policyholders alleged GEICO systematically underpaid by leaving out mandatory costs like sales tax and title, registration and inspection fees that a claimant needs to replace the vehicle. GEICO has agreed to several settlements on this theory, including a reported $33.5 million Texas settlement and a $19.5 million California settlement, among others.

These are contract-based claims: what the policy and state law require the insurer to pay on a total loss.

The Other Claims

GEICO has also faced a data-breach matter — resolved with New York regulators over 2020–2021 incidents in which customer information exposed through its online quoting tools was allegedly misused — and class actions alleging it added drivers to policies based on third-party data and raised premiums without the insured’s action. Earlier, pandemic-era suits argued GEICO kept excessive premiums while people drove far less.

These are different legal theories — data security, underwriting and premium practices — against the same large insurer.

What Policyholders Should Know

If your car was totaled, compare GEICO’s payment against your state’s rules on taxes and fees for total-loss settlements; the underpayment cases turned on exactly those line items. For any class settlement, eligibility and deadlines are set by the court-approved administrator, which is the only reliable place to verify a claim.
