Legal Analysis

The Recall

In 2022, Fitbit (owned by Google) and the Consumer Product Safety Commission recalled about 1.7 million Fitbit Ionic smartwatches because the lithium-ion battery could overheat and burn the wearer. Fitbit had received more than 115 reports of overheating and 78 burn injuries, including two third-degree and several second-degree burns — serious injuries from a device worn against the skin all day.

The recall covered the Ionic specifically, and Fitbit offered refunds to owners.

The Penalty and Lawsuit

In 2025, Fitbit agreed to a $12.25 million civil penalty to resolve CPSC charges that it failed to report the burn hazard to regulators promptly, as the law requires — a delay that let more people be exposed to the risk. A separate class action alleges the same battery defect exists in other Fitbit models beyond the recalled Ionic, including Versa, Sense, Inspire and Blaze devices.

The penalty is about reporting conduct; the class action is about whether the recall went far enough.

What Owners Should Know

Owners of a recalled Ionic should stop using it and pursue the refund remedy. Anyone burned by a Fitbit should keep the device, photos of the injury and medical records, which are the evidence for an injury claim. If you own a non-recalled model raised in the class action, watch for overheating and follow any updated guidance.
